Welcome to LukyNeko. The terms “we”, “us” and “our” refer to Bellet, trading as LukyNeko. Bellet operates this website and store, including all related information, content, features, tools, products and services (the “Services”). LukyNeko is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with our policies (including our Privacy Policy and Refund Policy), set out your rights and responsibilities when you use our Services. Nothing in these Terms affects your statutory rights under applicable consumer law.

By using or accessing our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Services.

1. ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your country of residence, and you give us your consent to allow any of your minor dependents to use the Services.

You agree to provide accurate, current and complete information (including billing, payment and shipping details) when using our store. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.

2. PRODUCTS

We aim to display our products accurately, but colors or appearance may differ depending on your device settings. Product descriptions may change without notice. We may discontinue products or limit sales to certain regions at our discretion.

3. ORDERS

Placing an order constitutes an offer to buy. We reserve the right to accept or decline any order. An order is confirmed only when we have processed your payment and sent you confirmation.

Your purchases are subject to our Refund Policy [link]. You represent that your purchases are for personal use and not for resale or export.

4. PRICES AND BILLING

Prices are shown in euros and include VAT where applicable, unless stated otherwise. Prices do not include shipping or customs charges.

The price you pay is the price confirmed at checkout. We may change prices at any time, but changes will not affect confirmed orders. You agree to provide valid and up-to-date payment information.

5. SHIPPING AND DELIVERY

Delivery times are estimates only. We are not responsible for delays caused by carriers, customs, or events outside our control.

Risk of loss passes to you only when the goods are delivered to you or a third party you designate.

6. INTELLECTUAL PROPERTY

All content in our Services, including text, graphics, images, logos, and designs, is owned by Bellet or our licensors and is protected by intellectual property laws. You may use the Services for personal, non-commercial purposes only.

7. THIRD-PARTY TOOLS AND LINKS

We may provide access to third-party tools or links. These are offered “as is” without warranties. We are not responsible for third-party content, products or services.

8. RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify. Purchases are made directly with Bellet (trading as LukyNeko). Shopify is not a party to your transactions with us and has no liability for them.

9. PRIVACY

We process personal data in compliance with the EU General Data Protection Regulation (GDPR) and French data protection law. For details see our Privacy Policy [link].

Because our store is hosted by Shopify, certain data may also be processed by Shopify under their Privacy Policy.

10. FEEDBACK

If you provide us with feedback, reviews, or suggestions, you grant us a non-exclusive, worldwide, royalty-free license to use and publish it. You must own the rights to anything you submit and ensure it does not violate others’ rights.

11. ERRORS AND OMISSIONS

We may correct errors, inaccuracies, or omissions in product descriptions, pricing or availability at any time without notice.

14. WARRANTIES AND LIABILITY

We supply goods with the legal guarantees provided by French and EU law. This includes the legal guarantee of conformity (2 years from delivery) and the guarantee against hidden defects.

To the fullest extent permitted by law, we are not liable for indirect or consequential losses. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or your statutory consumer rights.

15. INDEMNIFICATION

You agree to indemnify and hold harmless Bellet, LukyNeko, Shopify, and their affiliates from claims or damages arising out of your breach of these Terms or violation of law.

16. GOVERNING LAW

These Terms and any disputes relating to your use of the Services are governed by French law. Disputes shall be subject to the jurisdiction of the courts of Paris, France.

17. CHANGES TO TERMS

We may update these Terms from time to time. Material changes will be communicated in accordance with applicable law. Your continued use of the Services constitutes acceptance of the updated Terms.
